Divorce in Kenya is governed by the Marriage Act, 2014, which recognises five types of marriage: civil, Christian, customary, Hindu, and Islamic. The grounds and process depend on the type of marriage, and for most marriages the recognised grounds include adultery, cruelty, desertion, exceptional depravity, and the irretrievable breakdown of the marriage. Kenya’s system is largely fault-based, meaning the fault must generally be that of the other spouse. The process moves from the petition to a first decree, known as the decree nisi, and then, after a waiting period, to the decree absolute that finally ends the marriage. Where a couple has children, custody and maintenance are decided under the Children Act, according to the best interests of the child. Marital fault does not decide custody; the court looks at what arrangement serves the child. Both parents have a legal duty to provide for their children, and maintenance is assessed on each parent’s income and the child’s needs, regardless of who has custody. Many custody and maintenance arrangements can be agreed between parents, including through a parental responsibility agreement, rather than fought out in court. The division of property on divorce is governed by the Matrimonial Property Act, 2013. Property is divided according to each spouse’s contribution, which includes non-financial contributions such as homemaking and childcare, and the division must be fair, though not automatically equal. Property division is often the most contested part of a divorce, particularly where a home, land, or business is involved, so a lawyer experienced in matrimonial property is valuable. The Act also provides for prenuptial agreements, which a couple can use to set out how property will be treated.
Paternity, establishing who a child’s legal father is and the parental responsibility that follows, is one of the most common family-law concerns in Kenya. It arises where a father seeks to assert his responsibility, where a mother seeks to establish a father’s responsibility for maintenance, or where parentage is disputed. Under the Children Act, 2022, the court can order DNA testing where it is in the best interests of the child, and establishing paternity opens the way to maintenance, custody and access, and inheritance rights. A prenuptial agreement is a contract a couple signs before marriage setting out how their property and finances will be treated, including in the event of divorce. Prenuptial agreements are provided for under the Matrimonial Property Act, 2013, and they are increasingly used by couples who want certainty about property acquired before or during the marriage.
