When something goes wrong at work, a dismissal, an unpaid claim, a redundancy, or a dispute, an employment and labour lawyer, formally called an advocate, helps you understand and enforce your rights. These lawyers act for both employees and employers: for employees who have been unfairly dismissed or denied their dues, and for employers who need to handle terminations, redundancies, and disputes lawfully. Employment law is one of the most active areas of practice in Kenya, because the rules on fair termination are detailed and the consequences of getting them wrong are significant. This page lists verified employment and labour lawyers in Kenya and explains how the main areas of employment law work.
Employment in Kenya is governed mainly by the Employment Act, 2007. For a termination to be lawful, it must be both substantively fair, meaning there is a valid reason related to the employee’s conduct, capacity, or the employer’s operational needs, and procedurally fair, meaning a proper process was followed, including a hearing where the issue is misconduct. Importantly, the burden is on the employer to prove the reason for the termination; if they cannot, the termination is treated as unfair. Where a dismissal is unfair, an employee can claim remedies including compensation of up to twelve months’ gross salary. An employment lawyer can assess whether a dismissal was fair and pursue or defend a claim.
Redundancy, the loss of a job because the role is no longer needed, is lawful only if the employer follows the mandatory procedure in the Employment Act. This includes notifying the labour officer and, where applicable, the union at least a month in advance, consulting, using fair selection criteria such as seniority, skill, ability, and reliability, and paying severance at not less than fifteen days’ pay for each completed year of service, in addition to notice and other terminal dues. A redundancy that skips these steps is treated as unfair termination, however genuine the business reason. A lawyer can check whether a redundancy was handled lawfully and pursue any shortfall in your dues.
Employment and labour disputes are heard by the Employment and Labour Relations Court, a specialised court of the same status as the High Court, established under the Constitution. It has divisions in Nairobi, Mombasa, Kisumu, Nakuru, and Eldoret, and it handles claims such as unfair termination, redundancy disputes, discrimination, withheld wages, and breach of the employment contract. Many disputes can also be raised first with a labour officer. A claim of unfair termination must generally be brought within set time limits, so acting promptly matters. An employment lawyer will know the right forum and procedure for your dispute and will represent you there.
Match the lawyer to your situation, whether you are an employee or an employer, confirm they are properly registered, and act within time.
